OpenVPN Inc. presents our updated policies to transparently show how we collect, use, or retain your data. By clearly and openly presenting the terms of our policies we hope to maintain the trust and confidence of all our valued customers. We are a Zero-Log service provider and Do Not keep records of your traffic, browsing, or activity while using our services. We do analyze website functionality for performance for purposes of improving our service offerings to our customers. Our priority is to educate and make it easy for customers to understand what data we collect, why we collect it, and how we use it.

Personal Data

We may ask for certain Personal Data to make our services available to you. We only ask for information associated with your account or the administration. When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, phone number or credit card information. You may, however, visit our site anonymously. OpenVPN will retain your Personal Data only for as long as is necessary for the purposes detailed in our Privacy Policy.

What OpenVPN Collects From our websites; www.openvpn.net and www.privatetunnel.com:

OpenVPN collects Personal Data only through web form submissions, primarily for the purpose of enabling the purchase of services and engaging in support. OpenVPN also collects anonymous information about how visitors use our web site; for example, OpenVPN utilizes web analytics software to track, in aggregate, the number of unique views received by the pages of the web site, the domains from which users originate along with many other analytical data points. Through the use of web analytics software, the OpenVPN websites may use "cookies" to assist the tracking of how users engage our website. Data Usage

What Data OpenVPN Retains From Private Tunnel Sessions:

Each time a user connects to our Private Tunnel service, we retain the following data for 14-30 days: the user's source IP address, the Private Tunnel IP address used by the user, connection start and stop time and total number of bytes used.

Why OpenVPN Retains Private Tunnel Session Data:

We retain Private Tunnel session data for 14-30 days to use with billing issues, troubleshooting, service offering evaluation, TOS issues, AUP issues, and for helping to prevent criminal activity performed over the service.

What OpenVPN Does Not Collect From Private Tunnel Sessions:

• We Do Not log a user's traffic or the content of any communications
• We Do Not perform deep packet inspection of your traffic, except where requested by the customer for firewall purposes.
• We Do Not perform shallow packet inspection of your traffic, except where requested by the customer for firewall purposes.
• We Do Not throttle your Internet connection.
• We Do Not rate limit Internet connection.

What OpenVPN Disclosures

Legal process disclosure:

Your Personal Data is never released to others, unless we are ordered by a court of competent jurisdiction to do so. OpenVPN never sells any Personal Data, usage information or any other information.

Civil Investigations:

OpenVPN will never release requested data for civil litigation unless commanded to do so by a court of competent jurisdiction in the matter. We will exercise all rights to restrict and protect user data.

Criminal Investigations:

OpenVPN cooperates fully with law enforcement agencies when presented with a valid subpoena issued through a competent court of law. In such cases, OpenVPN provides only the minimum required information regarding users identifying information and no more. When an investigation is criminal in nature, OpenVPN would not be able to disclose the fact of the investigation to the service user.

Third Party Payment Processors:

We use third-party services for payment processing (e.g. payment processors). If you use a credit card that information will be collected by the payment processor. We do not collect or store your credit card number.

Consumer Rights:

OpenVPN takes reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.
Whenever made possible, you can update your Personal Data directly within your account settings section. If you are unable to change your Personal Data, please contact us and we will make the requested changes for you.
